These Terms of Service ("Terms") govern your use of the DNA Fiber website and our professional fiber optic services. By engaging our services or using this website, you agree to these Terms.
Services
DNA Fiber provides professional fiber optic services including, but not limited to:
- Fiber Optic Splicing: Single-fiber fusion splicing, ribbon fiber splicing, and drop fiber splicing using industry-leading Fujikura equipment.
- Testing & Verification: OTDR testing, optical loss test set (OLTS) measurements, power meter readings, and comprehensive fiber characterization using EXFO test equipment.
- Documentation: Professional as-built documentation, test result compilation, and project reporting using Fast Reporter and industry-standard formats.
- Emergency Restoration: Rapid-response fiber restoration services for emergency outages and critical infrastructure repairs.
The specific scope of work for each project will be defined in a separate written agreement or statement of work between DNA Fiber and the client.
Quotes & Pricing
- All quotes provided by DNA Fiber are valid for 30 days from the date of issuance unless otherwise specified in writing.
- Pricing may vary based on project scope, location, fiber count, access requirements, scheduling demands, and other factors specific to each engagement.
- Additional charges may apply for work performed outside the original scope, including but not limited to emergency call-outs, after-hours work, travel beyond the agreed service area, and materials not included in the original quote.
- Payment terms will be specified in the project agreement. Unless otherwise agreed upon in writing, invoices are due upon receipt.
Service Delivery
- Scheduling: Project scheduling is subject to availability and will be coordinated between DNA Fiber and the client. We make every effort to meet agreed-upon timelines but cannot guarantee specific dates due to factors beyond our control, including weather, site conditions, and material availability.
- Site Access: The client is responsible for ensuring DNA Fiber has safe and adequate access to all work areas. This includes providing necessary permits, right-of-way clearances, and ensuring the work environment meets applicable safety standards.
- Safety Compliance: DNA Fiber is OSHA 10 certified and maintains strict adherence to all applicable safety regulations and industry best practices. All personnel are required to follow site-specific safety protocols. We reserve the right to suspend work if conditions are deemed unsafe.
- Cooperation: Successful service delivery requires reasonable cooperation from the client, including timely responses to communications, provision of necessary project information, and access to required infrastructure.
Limitation of Liability
To the maximum extent permitted by applicable law:
- DNA Fiber's total liability for any claims arising from or related to our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
- DNA Fiber shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, business interruption, or loss of profits, whether arising from contract, tort, or otherwise.
- DNA Fiber shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, power outages, network failures, or third-party service disruptions.
Warranty
- DNA Fiber warrants that all work will be performed in a professional and workmanlike manner consistent with generally accepted industry standards and practices for fiber optic splicing and testing.
- All splicing work is warranted to meet or exceed the loss specifications outlined in the project agreement. Typical splice loss targets are 0.05 dB or less for single-fiber fusion splices and as specified for ribbon splices.
- Test results are warranted to be accurate and performed in accordance with industry-standard testing methodologies using properly calibrated equipment.
- If any work is found to be defective or not in conformance with the agreed specifications, DNA Fiber will, at our option, re-perform the work at no additional cost within a reasonable timeframe.
- This warranty does not cover defects or failures caused by third-party actions, client-provided materials, pre-existing infrastructure conditions, or normal wear and degradation.
Termination
- Either party may terminate a service agreement by providing written notice to the other party. The notice period will be as specified in the project agreement or, if not specified, a minimum of 7 business days prior to the intended termination date.
- In the event of termination, the client shall be responsible for payment of all work completed and expenses incurred up to the effective date of termination.
- DNA Fiber reserves the right to terminate services immediately if: the client fails to make timely payments, work conditions are deemed unsafe, or the client materially breaches the terms of the agreement.
- Upon termination, DNA Fiber will deliver all completed work product, documentation, and test results to the client within a reasonable timeframe.
